NCO Financial is one of the largest collection agencies operating in the U.S. Unfortunately they have earned a bad reputation for putting in negative records on the consumers’ credit reports. They are often known to harass people in an effort to collect money by hook or crook. Their only aim is to get consumers to pay them the debt.

But, we as consumers, can take the following steps to stop NCO Financial from harassing us.

1. The first thing we need to do is send them a letter requesting them to stop harassing us. They should be made clearly aware of the fact that we would deal only with the creditor who we owe the money to, not to them or any third party agency.

2. If they continue to harass us after getting that letter, it would be wise of us to hire an attorney who can work on our behalf, use his/her expertise on this matter and let them firmly know about the same course of action.

3. It is likely NCO might stop contacting us if we can negotiate some kind of agreement with them. Once we enter into an agreement, we should let them know in writing that they will receive their first payment only after the negotiated terms are documented and sent to us in writing. It is very important to document everything.

4. Your last resort would be to file for bankruptcy if nothing else works on your favor. But remember, this is not what you should work towards as an easy solution. Give the whole process some time, try to work with NCO, check out all your options and make the right judgments accordingly.

Just like NCO has the right to contact us to make debt payments, we have our rights to defend as well. We have the right to dispute the bill, request NCO to stop calling us at inconvenient times, make a payment via mail and last but not the least get help from another company to help us deal with NCO.

There are various options that attorneys will suggest in order to get the negative items removed from our credit reports. The important thing is to be patient and work with NCO to enter into some kind of negotiation with them for making debt payments.

1. Disputing the account with the credit bureaus might be a very wise thing to do. We should most certainly dispute any questionable item that is reflected on the credit report.

2. NCO cannot expect you to pay off the debt without proving to you that you really owe them the money. Try the debt validation process, give NCO the chance to prove the validity of the debt they listed on your credit report.

3. If you owe money to them, you would need to pay them eventually but have realistic ideas about what you can afford. Work out a payment plan with them, let NCO know that this is what you can afford to pay; it is likely they will work with you.

4. Always be patient with NCO or any other collection agency. Their ultimate aim is to get the money from you, by being patient and calm; you can work with them and eventually have them remove the debt from your credit report.

No collection agency wants their reputation tarnished. We are the ones who should make informed decisions, use sound judgment to stand up for our rights. Sooner or later NCO will revise the way they do business with customers.

You are not alone if you are a victim of nco financial. You can beat nco financial at their own game, you really can.

In article one in this three piece series on the very basics of debt collection, I wrote about the differences between third party debt collectors and in house debt collectors. But no matter what entity or institution they work for, the goals of debt collectors are the same. First, they need to find the people or businesses that owe the debt, and inform them that they are delinquent in their payments. Generally, debt collectors will reach a debtor over the phone, but they are known to send mail as well.

The people who owe the money are known as debtors, or consumers, and often times they might move without leaving a forwarding address or appropriate phone number. Sometimes this is done on purpose to avoid being contacted by the debt collectors, other times this is just a mistake. In these cases, the collection agents might check with telephone companies, the post office, credit bureaus, and former neighbors to get the new address.

If a collection agent gets a hold of a consumer’s neighbor, they are strictly banned from letting that neighbor know why they need the number, and are not allowed to reveal that the consumer owes a debt. The process of tracking down a debtor’s new address or phone number is called “skip tracing.” Collection agents will utilize computer systems to track when debtors or companies change their contact information on any of their open accounts automatically.

As soon as the collection agents locate the consumers they will get in touch with them to let them know about overdue accounts and to request a payment. Debt collectors generally call from 1-800 numbers and must verify that they are speaking with you before they can proceed. If anyone else picks up the phone, they cannot inform them of your debt, all they can do is ask that you call them back at such and such number.

If a collection agent does get in contact with a debtor, and verifies that they are speaking with them, they will let them know their name, the details of their overdue accounts, and that this is an attempt to collect and anything said in this conversation may be used for the purposes of collection. To Be Continued In Part Three.

Are you new to the stock market game? Not a problem! This series of articles on mutual funds will make it easy for you to understand what a mutual fund is, what it is all about and whether it is worth your while to invest in one. My first three articles are titled “Mutual Funds For Beginners” and they lay down the basics.

The next one is called “Expenses Associated With Mutual Funds” and it covers the basic things you can expect to be charged for if you decide to invest in a mutual fund. The last two are called “Is Investing in a mutual fund worth your while?” and they cover the pros and cons of mutual funds. First let’s break things down to a molecular level and talk about securities. The fancy definition of a security is a negotiable instrument representing financial value.

This definition is kind of hard to grasp so let us take a look at an example of a security to help you get a better idea of what one is. A stock is considered a security. Stocks can be purchased or sold, and therefore have financial value, and a share of stock literally means that as a stockholder you “share” a fraction of ownership in the company whose stock you own. Bonds, which are contracts to pay back money with interest on specified dates, are also securities. If you hold a bond, you know that you are going to receive money on these set dates, so bonds have financial value as well.

Stocks are bought and sold at exchanges called stock markets, and bonds at bonds markets. A bonds market is usually very different from a stock market. If you were looking to invest in stock, or sell the stock you have, you would enlist the help of a stock broker who would charge you a commission for performing this work for you.

Typically, unless you own stock from the company you would like to buy from already, you are going to want some sort of a broker to help you do this. The same goes for bonds – you are going to want a dealer. Now that we have the very basics down, let’s go over mutual funds. See my article “Mutual Funds For Beginners Part Two!

Within today’s current overall economy, it is advantageous to be well skilled in debt collection processes. A number of individuals and organizations are suffering through the decline in economic conditions and are discovering it a lot more difficult to sustain current payments, which leave their creditors in a bad situation in which their own income is affected. In order to assure that adequate funds are coming in to support the business, collecting debt has become an vital portion of the financial process in a number of organizations.

Still, there tend to be a number of reasons that successfully collecting debt is not as commonplace as it should be. Mistakes in judgment and processes are made in the majority of companies, and being equipped to recognize and also eliminate those mistakes can maximize gain greatly.

One of the most frequent blunders in collecting debt is a lack of straightforward regulations. Rather than having a identified set of guidelines and regulations through which a debt collection unit should be run, it is normally a verbal training approach which is subsequently left open to the interpretation and individualization of those handling the clients.

This decreases organization within the office and leads to inconsistency, that may in fact cause the client to see efforts at collecting debt as not serious or harmful to their financial well being. A lack of an apparent policy will cause debt collectors to not be taken seriously at their word, which inturn impacts the bottom line of the company as it attempts to recover lost or past due payment.

Whenever there are no policies set forth, and inconsistencies happen, it is easy for clients to come back with those inconsistencies and say that your debt collection policy is unclear or was defined to them in a different manner. With no documentation to back up your own claims, your business can then become liable for its own debt and may not be able to demand repayment from past due clients. This is a sore error that has, sadly, caused the demise of businesses in the past.

An additional problem with collecting debt is mistakes in judgment based mostly on fear of loss. In a few instances, a business might not be enthusiastic about getting in touch with a client to recover a past due payment because their customer list has grown short in these poor economic times, and they are fearful of losing a “good client”. However, if this is analyzed more closely, it becomes evident that a client who has not settled their debt is not a “good” client but a draw on the organization.

It doesn’t matter how long that client has been faithful to the business; if the debt collection operation in fact offends them whenever a payment is overdue, it may be to the organization’s gain to drop their business anyway, no longer giving a credit line to an individual not dependable enough to continue payment and who draws so hard on company resources in the debt collection department.

Training of in house debt collection associates with a distinct and understandable, documented set of plans, as well as learning to take into consideration the worth of a particular customer, can aid in maintaining the bottom dollar high during a falling economy so that collecting debt does not result in a strain to the company based on these common but harmful mistakes.

Montana has published, spoken publicly and functioned as a business advisor on the subject of collection agency procedures for thirty years. David encourages you to examine and see a whole lot more research on the subject of how to collect a debt

Failure to receive payment for jobs and services can lead any person or business down the path of financial ruin. Before letting unpaid debts put someone or a company out of business, consider using a collection agency to recover lost sums of money. However, there are definitive factors that should be looked at before choosing a company.

Like any business, the debt collection industry has become specialized. Certain types of agencies specifically target groups and people that fit under their scope. This specialty gives different collection agencies direct experience in dealing with people and situations in their perspective fields. Find out what a collection agency deals with and choose accordingly.

Collection agencies that focus on medal collections are excellent options for people, doctors, and hospitals to collect restitution on the unpaid bills. The experience of the collectors in this field will aid in getting sums of money to the parties that need them. This, of course, will be performed for a piece of the money recovered by the agency.

Another large group of debt collectors revolves around the insurance business. This could be for homeowner insurance, car insurance, business insurance, or even boat insurance. Collectors in this field retrieve money for parties who were at fault for causing accidents. This company also aids people in getting insurance companies to pay premiums quickly.

People who are looking for the correct collection agency for them or their business they must also consider the prices a company will charge. For example, would you want to deal with a company that managed to collect the entire debt, but required a 50 percent finder’s fee. That was an exaggeration, but the point remains that in employing an agency, one must read all the fine print.

Picking the right collection agency for a person’s needs center on two themes. It is imperative to find a collection agency that has plenty of experience in the field you are trying to get your money back in. It is also important to read over any contract carefully to avoid any miscommunication between the collector and you.

Most know exactly what a collection agency is – and what the nature on their business is. Those who have been through it, will tell you that financial debt is hard enough to face on its own, without being made nearly unbearable by a debt collector with an attitude.

Wouldn’t it be fun to deliver a little pay back – so the world’s collection agencies get a little taste of the pie they’ve dished out to others over the years? Well, in the interest of keeping the playing field leveled – and to have a laugh – here’s a few ideas to put into play, that might balance the scales a bit if you’re ever stuck in a predicament where you’re phone has become the enemy:

Just say NO! Nowadays, it’s easy to tell when you have a debt collector on the line, as most agencies have started to use a screening process. This is so they won’t waste time bullying the wrong person – which can spell legal trouble for THEM, down the road. How it works is when a person answers his phone, a canned voice comes on and tells him to confirm, or deny, if he is the person they’re trying to reach. The person is usually instructed to state “yes”, if they’re confirming, or to just hang up if they’re not. If you agree you’re their person, a live being will come on the line to commence the torture games. If you hang up – they’ve been informed they’ve made a mistake.

A better – and really hilarious – thing to do, is to wait for the recording to stop and a live person to come on instead. This is your entry – before they even say Hello, start screaming at the top of your lungs that “they have the wrong person again, you’re starting to get really “shaky”, and you’re warning them to stay away, because your “mind’s getting worse!” Pull this scene on every collector who harasses you – eventually, some will probably fall away, not wanting to waste anymore time on a crazy person.

Just “visiting” – Pretend to be a visitor in your country – someone who doesn’t speak the language, or ANY language for that matter. Speak gibberish, mumbling incoherently. And, if you pick up the phone and answer as “you” – don’t worry. Just put them on hold and tell them you’re getting the person they want, right away. Give it a few moments to keep them hanging. When you finally come back, make sure you’re in character for the rest of the call. Be hard to understand and repeat everything they say in a heavy accent. From time to time, throw out a word or two – like “yes” or “sure” – just to make them think they might be getting somewhere in making you understand the nature of the call, then start mumbling nonsense again. You’ll find you’re suddenly as big a headache to them, as they’ve been to you.

Be a “clinging” vine – This is a great way to chase collection agencies off! Just pretend to be starved for human contact in any form, and act needy. Right away, explain how you’d really love to pay your debts, however “your recently diagnosed incurable, extra strength dose of leprosy” prevents you from doing anything at all – except for sitting in a darkened room, and feeling lonely as your limbs drop off, one by one. Then, to keep them captive, go off into an hour-long rant about each symptom and detail of your “condition”. Direct the conversation to a personal level, and bore the caller with stories of your early years – including every shattered dream and your many regrets. If they insist on having to go, ask them for their home phone number, so you can call them back when they’re off work – pin them down to a “time” when they’ll be available. After a couple of sessions from you, you probably won’t have to take many collection calls, at least for a a few weeks.

Although not in the “nice” category – it’s fun to imagine how a collection agency would respond to these “paybacks” for their past torture tactics. And you can try this yourself if you’re ever in the unfortunate position, and things get heavy with rude phone calls – or not. But the real intention behind this piece was to cast some laughter on a somber situation – so the reader can see there is always a light at the end of every tunnel – no matter how bad things seem to be at the time.

Among many other collection agencies available around ever corner of the cities one would find it difficult to land upon a right choice where he or see would not develop their problems instead do sorting them out. One best option available at these circumstances is the California collection agency which we are going to discuss in detail down under about the merits and limitations for you to analyze and get benefited out of the information provided.

It is a commonly found aspect that all the commercial collection agencies do charge a good piece of share as commission for them in doing the recovery. This is because of the numerous amount of hassles normally involved in the process of recovery.

On the other hand if you want to find someone who does it for lesser costs compared to the others in the market then you should certainly opt for California collection agency. They do collect minimum money in the case of getting your money back to you or otherwise they do not get any money for their services rendered in their endeavors.

Also in other words it also goes to show you the fact they would at any case get the recovery done by hook or crook to avoid facing losses from the company point of view due to mere efforts without result.

The ways of handling the defaulters is also very genial and decent enough and they do not opt any harsh way of approaching at it as long as they can get it sorted out in proper effective way of communication. They found it to be very effective.

Another peculiar feature of California collection agency is that they do not collect any advance money or registration fees for taking up your care. Free analysis of your care is done and in taking the case without any advance money from you the case proceedings are done with expenses borne by the agency itself only on successful completion of the project they are retrieved their fees. So both your goal goes together in achieving recovery and becomes a common ambition. Hence the results are very often successful.

Lengthy age long disputes and litigations of dynasties have all been resolved in peace just out of persuasive communication with the parties more effectively with the primary goal of sorting out the issue. Years of expertise in the trade had offered the experts of California collection agency the caliber to handle it with naive and get it sorted out in a much more simple fashion.

It is just especially for all the above reasons stated the California collection agency is considered to be the foremost choice amidst many others in the trade

It is not uncommon for larger businesses to have their own debt recovery department, which is responsible solely for the collection of the company’s bad debts, however for small businesses that wouldn’t have this capability, commercial collection agencies may make wise business sense. Many bigger organizations also are outsourcing this vital operation to commercial collection agencies finding it cheaper to use these professional services whenever required.

Countless smaller sized business proprietors are involved in just about every function with the day-to-day operating of the company, so when the debts aren’t currently being paid, can easily become tied up with going after money instead of being focused on other very important responsibilities. These businesses may suppose it’s a costly option to hire commercial collection agencies, but actually it generally demonstrates to be just the opposite.

For one thing, by utilizing commercial collection agencies, their particular capabilities will generally mean that debts are settled a great deal quicker, thusly improving the cash flow and viability of your organization. By chasing these bad debts yourself it is very often that you just do not realise the cost to the business in some other ways. Generating telephone calls coupled with re-sending bills and reminders is often very time intensive, not to mention stressful. Time expended chasing money is time not spent in other activities, which are required for the business to expand and operate profitably.

There are other reasons why it usually is a clever choice to employ commercial collection agencies. If a client of yours receives a reminder notice chances are that they’ll not necessarily bother about it too much or even take it too seriously. They’ll already know that they haven’t paid you and owe the money so the letter could have already been expected, but they will not believe any serious penalties in not paying and for that reason not be in any kind of hurry to clear the debt.

However, once they get a reminder notice from commercial collection agencies most companies behave a lot differently. The correspondence will be considered much more seriously because they may worry, for instance, that their credit score can be damaged if they do not pay the debt quickly. This one basic truth can and does make a huge difference in the amount of time taken to repay money owed when receiving an ‘official’ notice from commercial collection agencies. Your debtors will more often then not be prompted swiftly into settling their bills, or beginning a repayment plan where the debt is paid back little by little.

When employing commercial collection agencies you should make sure that the company is respected and follows professional work ethics. They are essentially representing your organization and you should ensure that you choose a company which has a good standing as well as will get good results.

Payment is likewise a significant issue which requires discussing prior to any decisions are made. Commonly they’ll require a percentage of the money that is recovered; rest assured that if you utilize the assistance of good commercial collection agencies your business will soon begin to benefit from that decision.

Several businesses find the thought unpleasant of chasing after money from highly regarded customers who might have been trading together for many years, simply because they’ve fallen onto tough times. These are very difficult times for all businesses, and by giving over the responsibility to commercial collection agencies you can possibly help to salvage a trading relationship for the future.

As collection agencies go, I have never heard anyone say anything positive about them. Asset Acceptance Collection Agency (AACA), also known as Asset Acceptance Capital Corporation, is no different.

AACA is a collection company which focuses on the primary, secondary and tertiary debt markets. For the layperson, this means that they purchase charged-off debt from creditors which has already been through one, two or three collection agencies’ attempts at collection. Online research indicates that AACA’s tertiary accounts (3rd time at collection) “make up about half of its portfolio.” http://www.hoovers.com/company/Asset_Acceptance_Capital_Corp/rtjrhci-1.html.

In addition, AACA purchases different types of debt. For instance, it typically holds a well-rounded mix of overdue credit card, consumer loan and utility debt, with about half of its purchased debt in the credit card debt genre, i.e. Visa, MasterCard and Discover Card. This debt is likely purchased at a huge discount, most probably for cents on the dollar. Once purchased, collection attempts begin.

AACA reports in its November 4, 2009, Quarterly Report, that “[s]ince these receivables are delinquent or past due, we are able to purchase them at a substantial discount. We purchase and collect charged-off consumer receivable portfolios for our own account as we believe this affords us the best opportunity to use long-term strategies to maximize our profits.” http://biz.yahoo.com/e/091104/aacc10-q.htmo. And, AACA does maximize its profits! In 2008, AACA reported $234.2M in revenue.

Warren, Michigan, is where AACA is headquartered. AACA had 1,651 employees working for it in 2008; today, AACA has over 1,700 employees. AACA is publicly traded and, as such, is listed on the NASDAQ (AACC). I believe I mentioned earlier that AACA’s revenues in 2008 totaled $234.2M. It would seem that the economic woes of the typical worker in these financially depressed times are working well for the collection agencies!

As with most collection agencies, you can attempt to negotiate your debt with AACA. To do this, you would contact AACA, which should not be hard to do since they will likely be calling and sending you threatening letters, and see if they will accept a lump sum payment in full payment of the debt owed in exchange for a reduced amount due. Of course, this will only work if you have a lump sum of cash available to you.

Another option is to see if they will allow you to make monthly payments. This may be easier for you to stomach financially; however, chances are AACA will be less likely to reduce the balance owed if you will be making payments.

All in all, it is best to try not to become entangled with any collection agency, if at all possible. If you do, try to extricate yourself as quickly as possible.

Can you imagine how nerve-wracking it would be to deal with a collection agency which is collecting a debt for another collection agency? This is how LVNV Funding Collection Agency (LVNV) normally handles the debt it acquires from original creditors.

The process goes something like this – LVNV purchases debt from an original creditor to whom you owed a debt. At this point, you no longer owe the debt to the original creditor, but to LVNV. After the purchase, LVNV assigns the debt collection to a third-party collection agency that then attempts to collect the debt. Debt is collected for LVNV by many different collection agencies. Some of these collection agencies are, or have been, Resurgent Capital Services; Sherman Financial Group, LLC; and, Alegis Group, LP.

You should always know who the major players are when you deal with a collection agency. For sure, you are one of the major players; however, you need to also know who the collection agency is representing. If you are given a name which is unfamiliar to you, you need to ask if that party purchased the debt from one of your creditors. If so, you should ask for the name of the original creditor as well as for the underlying basis of the debt.

If you decide to tackle the collection agency yourself, as opposed to seeking the services of a consumer credit attorney, you should make yourself familiar with the various consumer rights laws. In other words, you need to know your rights as a consumer! It would be wise to perform an online search for consumer credit law. Remember, if you decide to do this on your own, you need to know the law as well as the debt collectors.

Knowing this, it is important that you understand, at a minimum, the Fair Credit Reporting Act (FCRA) and the Fair Debt Collections Practices Act (FDCPA). Substantial consumer rights are contained in the FCRA. This is a Federal law which is enforced by the Federal Trade Commission. On the flip side, the FDCPA contains the practices which collection agencies must abide by. If the FDCPA is violated by a collection agency, it may find itself facing fines or legal action. If there are numerous FDCPA violations, the collection agency may be closed down by the government.

If you are wondering how to deal with a company representing LVNV, you should first determine if the debt is really yours and that you actually owe it. If this is indeed the case, you have a couple of things you can consider. To begin, you can just buckle down and try to arrange a payment plan. This will get the collection agency off your back and will help with damage control as it pertains to your credit score. For the most part, collection agencies just want to get debts paid. They really are not interested in pursuing a law suit against debtors unless it is absolutely necessary.

If you feel you just can’t stomach the thought of making monthly payments, a lump sum payment may be a better option for you. For this option, you will need to have some money to pull from in order to make an offer. Be sure to negotiate for a lesser total amount due in exchange for the lump sum payment. Another tip is to negotiate at the end of the month when collectors are attempting to obtain bonuses and meet quotas.

It is important that you know your rights as a consumer. Remember, you need to know these rights as well, if not better, than the collector you are dealing with. Lastly, if you are able to reach an agreement with the collector, demand that the agreement be in writing and signed by both parties.
